NATURAL DISASTERS AND ACCESS TO JUSTICE:
THE CHALLENGES FACED BY VULNERABLE COMMUNITIES IN THE CONTEXT OF PL Nº 2043/2024

This article analyzes the challenges faced by vulnerable communities in the context of increasing natural disasters, in light of Bill No. 2043/2024, which proposes the creation of the National Policy on the Rights of Populations Affected by Natural Disasters (PNADN). Based on a qualitative approach, through bibliographic and documentary review, the study investigates the relationship between environmental degradation, social vulnerability, and access to justice, with emphasis on the role of the State, the Judiciary, and civil society in the implementation of environmental justice. The research findings reveal that the most affected populations, particularly low-income communities, traditional peoples, and women, face multiple barriers in accessing basic rights, including housing, reparation, and resettlement. The study also found that Bill No. 2043/2024 represents a significant legal innovation by recognizing the centrality of the victim, proposing concrete mechanisms for collective reparation, ensuring community participation, and establishing oversight bodies. The proposal moves forward in institutionalizing environmental justice in Brazil, aligning with the constitutional principles of human dignity and environmental protection.
