Abstract

This research analyzes the fraud of gender quotas in Brazil's electoral system and the application of Ruling 73 of the Superior Electoral Court. The paper addresses the importance of gender quotas for promoting equity in political representation and discusses the legal implications of using fictitious candidacies to comply with the gender quota. The legal analysis studies the evolution of inclusion policies and the impediments that still limit women's effective participation in political life. Using case law and data from recent elections, this paper identifies the main challenges and proposes suggestions to improve the effectiveness of quotas and ensure greater representation of women in Brazilian elections.
