O DIREITO A SAÚDE DO APENADO E O PRINCÍPIO DA DIGNIDADE DA PESSOA HUMANA
Abstract
This scientific article aims to analyze the application of the National Health Plan in the Penitentiary System, in the reality of the Brazilian prison system and its close relationship with fundamental rights and the maintenance of Human Dignity within hospitalization units. We aim, through research, to verify effective compliance with the Penal Execution Law and the National Penitentiary Health Plan that seek to provide assistance and inclusion for incarcerated people; in addition to identifying the sanitary conditions of Brazilian prisons based on research in the media; promote, through this research, knowledge of the public health problem involving prison and, finally, identify means and plans to improve the Brazilian penitentiary system with regard to the right to health of prisoners. The methodology used was bibliographic, based on several books by authors who are references on the subject and the relevant Brazilian legislation, in particular the Penal Execution Law, which highlights the right to health care, and Interministerial Ordinance no. 1777/2003/GM, which established the National Health Plan in the Penitentiary System, and the Federal Constitution of 1988, taking as its starting point the principle of human dignity, and the fundamental rights and guarantees that ensure the prisoner's health , physical and moral integrity.
